Terms & Conditions

I. DEFINITIONS

  1. customer – consumer who purchases delCane products in the delCane online store or uses the delCane online store;
  2. delCane – DELCANE Ewa Lignowska seated in Warsaw at ul. Fosa 35B/15, 02-768 Warszawa (Poland), entered into the Central Business Activity Register of the Republic of Poland maintained by the Minister of Development [www.firma.gov.pl], NIP (Taxpayer Identification Number): 782-169-63-25, REGON (statistical number): 634362583;
  3. delCane store – online store operated by delCane;
  4. product – product (merchandise) offered for sale by delCane in the delCane store;
  5. terms and conditions of use and sale – these terms and conditions of use and sale for the delCane online store;
  6. order – request to purchase a product offered by the delCane online store, made by a customer, in accordance with these terms and conditions, in the delCane online store;
  7. sales agreement – product sales agreement entered into by a customer (Buyer) and delCane (Seller);
  8. business day– a week day that is not a Saturday, Sunday or a public holiday by Law in the Republic of Poland;
  9. Consumer Rights Act – the Act of 30 May 2014 on consumer rights;
  10. Act on the provision of electronic services – the Act of 18 July 2002 on provision of electronic services;
  11. Personal Data Protection Act  the Act of 29 August 1997 on protection of personal data;
  12. c.c. – the Act of 23 April 1964, the Civil Code.

 

II. GENERAL PROVISIONS

  1. These Terms and Conditions have been published pursuant to Article 8 of the Act on provision of electronic services.
  2. These Terms and Conditions specify the rules for the customers’ use of the online store operated by delCane; in particular, they regulate as follows: placement of orders in the delCane store, conclusion of sales agreements, delivery of products, complaints, provision of the newsletter service, registration and use of a personal account in the delCane online store.
  3. The delCane online store is operated by delCane and allows to purchase products available in the delCane store via Internet, using the URL: www.delcane.pl (Polish language version) and www.delcane.com (English language version).
  4. Customers have access to full information on each of the products available in the delCane store including in particular: price information, detailed size, materials of which specific products are made, direction of use (cleaning and maintenance), intended use of each product.
  5. Product information in the delCane store, especially descriptions and prices of products, constitute an invitation to make an offer to enter a sale agreement within the meaning of Article 71 of the C.C., in accordance with the provisions of these Terms and Conditions.

 

III. DELCANE STORE TERMS AND CONDITIONS OF USE

  1. Each customer is required to read these terms and conditions and follow them from the beginning of using the delCane store. Customers confirm the fact of reading and acceptance of the terms and conditions of use in the delCane store’s system during placement of an order.
  2. Acceptance of these terms and conditions by the customer is a prerequisite of placing an order and conclusion of a sales agreement between the customer and delCane.
  3. Everyone can access these Terms and Conditions by clicking the “Terms and Conditions” tab on the delCane store’s website.
  4. Each customer using the delCane store is obligated to:
    • Use the delCane store in a manner consistent with the applicable law, these Terms and Conditions and generally accepted principles of using the Internet;
    • Use the delCane store in a manner that does not violate personal interests of delCane;
    • Use the delCane store in a manner that does not violate personal interests or rights of third parties;
    • Observe intellectual property rights of delCane, in particular, by using the content published in the delCane store for the customer’s own purposes;
    • Use the delCane store in a manner that does not disrupt its operations;
    • Use the delCane store in a manner that does not cause major inconvenience to other customers or delCane.

 

IV. CONCLUSION OF A SALES AGREEMENT

  1. A sales agreement is concluded between a customer making a purchase in the delCane online store (Buyer) and delCane (Seller).
  2. To conclude a sales agreement, a customer needs to place an order in the delCane online store.
  3. Customers can place orders in the delCane store 24 hours a day, 7 days a week.
  4. Customers can place orders without the need for permanent registration of their data in the delCane online store’s database (i.e. purchase without registration). In case of a purchase without registration, customer’s personal information will be processed by delCane only for the purpose of fulfilling the order, execution of the sales agreement related to this order and archiving information related to the order and the sales agreement.
  5. A customer may at any time create their individual customer account in the delCane online store by filling out and accepting the registration form available on the delCane online store’s website, in the “My Account” tab. The registration form is available on the delCane store’s website, also in the “Log in” tab. Registration is one-time and requires the customer to provide the information specified in the registration form and to set an individual password to access the account. Each login to the individual customer account in the delCane online store requires the customer to enter, in the “Log in” or “My Account” tab, their e-mail address provided in the registration form and the password created during the registration process (password). delCane shall not be liable for damages incurred by the customer, resulting from their disclosure to a third party of access information to their individual customer account in the delCane online store. After creating the individual customer account in the delCane online store the customer will receive, to the e-mail address specified in the registration form, confirmation of the activation of the individual customer account in the delCane online store, which is tantamount to concluding a contract for the provision of a free-of-charge service to operate the individual customer account. After creating the individual customer account in the delCane online store, the customer may at any time edit their data by logging into their account. Also, the customer may submit to delCane, via e-mail sent to [email protected], a statement of resignation from the individual customer account in the delCane online store. In this case, the individual customer account in the delCane online store will be immediately deleted, of which the customer will be informed by e-mail sent to the address provided by the customer. During the registration process, the customer can give their consent to the processing of their personal information for marketing purposes, i.e. agree to receive the delCane newsletter. The consent is voluntary.
  6. An order in the delCane online store can be placed by filling in the required fields in an order form available upon logging into the individual customer account or with an order form that can be submitted without registration. The required fields in the form contain information necessary for the product delivery and issuing of a VAT invoice.
  7. To place an order, please choose products from those offered in the delCane online store, including their colour, size and quantity, by adding them to the “Shopping cart” (“Buy Now” button).
  8. Until confirmation of the choice of products by clicking the “Place Order” button, the customer can change the order or modify the products included in the order, or amend the shipping/billing information. If the customer intends to change the order or modify the products included in the order from the “Order” page with the order summary they should – before clicking the “Place Order” button – go back to the previous page and enter the shopping cart (“Shopping Cart” tab).
  9. Confirmation of the choice of products by clicking the “Place Order” button entails the obligation to pay for the chosen products. If the customer chooses to pay for the ordered products using the PayU or PayPal services after clicking the “Place Order” button, they will be automatically redirected to the selected payment service.
  10. Placing an order by the customer (by clicking the “Place Order” button) constitutes the customer’s offer submitted to delCane in order to conclude, under of these Terms and Conditions, a sales agreement.
  11. After placing an order in the delCane online store, the customer will receive a message displayed on the website of the delCane online shop, containing confirmation of receipt by the delCane online store of the order constituting an offer to purchase the specified products by the customer.
  12. The customer will receive, via e-mail sent to the provided address, an order confirmation evidencing acceptance of their offer for execution, including in particular information about the ordered products, their quantity and value of the order. When the customer receives the order confirmation, the sales agreement is concluded for the products ordered by the customer in the delCane online store.
  13. The sales agreement is concluded with the content in accordance with these Terms and Conditions. The sales agreement is concluded between the customer and delCane in Polish (when the order is placed on www.delcane.pl) or in English (when the order is placed on www.delcane.com).
  14. The customer has the right to cancel the order before receiving the order confirmation from delCane to the provided e-mail address. The order cancellation statement should be sent to delCane via e-mail to the address [email protected] or using the contact form available on the delCane online store’s website in the “Contact” tab. An order cancelled by the customer will not be fulfilled.
  15. Recording, securing and disclosure of relevant provisions of the sales agreement concluded by the means of distance communication shall be done by printing and handing over to the customer of the proof of purchase (invoice) with the delivery of products.
  16. The information provided by the customer during the process of placing an order must be true, accurate and up-to-date.
  17. DelCane reserves the right to refuse to confirm the order, i.e. reject to confirm the acceptance of the offer for execution, or to cancel the execution of the order (order cancellation) in each of the following cases:
    • Contact details provided by the customer prove to be false or incomplete or inaccurate to the extent that it prevents the execution of the order, including in particular the effective delivery of the parcel;
    • Full payment for the order has not been authorized by the PayU or PayPal electronic payment system chosen by the customer;
    • Full payment for the order has not been credited to the bank account of intermediaries in the transaction (PayU or PayPal) or to the delCane’s bank account, within five days from the date of the order, when the customer – at the ordering stage – chose to pay via available payment systems (PayU or PayPal) or by a bank transfer directly to delCane’s bank account (i.e. payment in advance);
    • The order form was not completed in full or was completed incorrectly;
    • The order was placed in violation of the provisions of these Terms and Conditions;
    • The delCane online store ran out of product ordered.

If any of the aforementioned cases takes place, delCane shall, within three business days, inform the customer about the situation via e-mail to the address provided by the customer. At the same time, delCane shall refund the product price paid by the customer and any delivery costs (as long as these amounts have been paid by the customer). The refund of the amounts paid by the customer shall be made in the same form as paid by the customer, within three business days starting from the day after the day on which the payment was credited to delCane’s bank account.

 

V. PRICES AND PAYMENTS

  1. Product prices in the delCane online store are gross prices, i.e. inclusive of VAT at the applicable rate.
  2. Prices in the delCane online store in the www.delcane.pl domain are specified in the Polish Zloty currency. Prices in the delCane online store in the www.delcane.com domain are specified in the EURO currency.
  3. Product prices do not include delivery costs, taxes or customs duties that may be charged in the country of delivery in the case of delivery outside the European Union.
  4. The payment method depends on the customer’s choice. DelCane offers the option to use the following payment methods:
    • Before the delivery, via the PayU payment system (operated by PayU S.A. based in Poznań, at ul. Grunwaldzka 182, 60-166 Poznań (Poland), entered into the register of entrepreneurs maintained by the National Court Register, under the number KRS: 0000274399). Methods and terms of payment are available on the www.payu.pl website;
    • Before delivery, via the PayPal payment system (operated by PayPal (Europe) S.à r.l. et Cie, S.C.A., based at 22-24 Boulevard Royal, L‑2449 Luxembourg). Methods and terms of payment are available on the www.paypal.com website;
    • c) Before delivery, via a standard bank transfer directly to the delCane bank account (payment in advance), using the following bank account numbers in ING Bank Śląski:
      – bank account number: 33105015201000002263950939 – for payments in Polish zlotys (PLN);
      – bank account number: PL 52105010251000009225237503 – for payments in Euros (EUR);
      The transfer’s title should contain the customer’s name & surname and order number.
    • On delivery, cash paid to a courier (Cash on Delivery), with the proviso that this form of payment is available only for deliveries within the Republic of Poland. If the customer chooses to pay the courier in cash (cash on delivery) the system will add to the delivery cost an additional cash-on-delivery fee, to be paid fully by the customer.
  5. If the customer chooses to pay via the available payment systems (PayU or PayPal) or via a bank transfer directly to delCane’s bank account (payment in advance), and the full payment amount is not credited to the bank account of the intermediaries in the transaction (PayU or PayPal) or to delCane’s bank account within five days from the date of the order, the order will be cancelled. In this case, the customer can place the order again. Fulfillment of the order paid for via the available payment systems (PayU or PayPal) or via a bank transfer directly to delCane’s bank account will start after the payment is received.
  6. The price of a particular product is specified on delCane online store’s website. The price is binding on the parties from the moment the customer receives, to the e-mail address they provided, an order confirmation, regardless of the changes in the price in the delCane online store which occur after sending the order confirmation to the customer.
  7. DelCane reserves the right to change, at any time, the prices of products offered in the delCane online store, and to run or cancel promotional campaigns, provided that those changes do not violate the rights of persons who entered into sales agreements in relation to the products in the delCane online store prior to those changes.

 

VI. DELIVERY

  1. If the place of delivery is located in the territory of the Republic of Poland products are delivered – depending on the customer’s choice made when placing the order – to the indicated address by the DPD courier company (DPD Polska Sp. z o.o.) or to the Paczkomat InPost self-service parcel pick-up station (operated by InPost Paczkomaty Sp. z o.o.), with the proviso that the delivery to the Paczkomat InPost self-service parcel pick-up station is available only for parcels that meet the specified requirements regarding their dimensions. The aforementioned choice will be presented to the customer during the order placement process only if the products selected by the customer from the delCane online store, when packed, meet the dimensions-related requirements specified by InPost for deliveries to Paczkomat InPost self-service parcel pick-up stations.
  2. If the place of delivery is located outside the territory of the Republic of Poland products are delivered to the indicated address by courier companies: UPS (UPS Polska Sp. z o.o.) or DPD (DPD Polska Sp. z o.o.), whereas during the order placement process the system will automatically select the least expensive of the above-mentioned courier companies, taking into consideration the parcel’s dimensions and the delivery address provided by the customer. At the same time, the customer will receive a message on the delCane online store’s website, which of the above-mentioned courier companies will be used to deliver the ordered products.
  3. The costs of delivery of products shall be borne entirely by the customer unless delCane expressly relieves the customer from the obligation to pay such costs. The costs of delivery of products are indicated in the order summary. The customer can check the delivery costs during the order placement process by putting the products into the shopping cart, going to the checkout and providing all data necessary for the delivery. In the order summary displayed prior to the order placement, the delivery cost calculated by the system for the delivery of products to the provided delivery address will be shown. In the case of delivery to the address outside the European Union, the indicated delivery costs do not include any taxes or customs duties (if applicable) that may be charged in accordance with the laws of the country, where the products are delivered to. Any taxes or customs duties shall be borne the customer in full. Placing an order constitutes acceptance of the cost and terms of delivery of products.
  4. Orders are fulfilled within five business days from the date of the order, subject to the next clause, i.e. clause 5 below. In exceptional cases, the order fulfilment time may be extended – in this case, delCane will notify the customer of this fact via e-mail sent to the address specified in the order, indicating the new order fulfilment time.
  5. If the customer chooses to pay via the available payment systems (PayU or PayPal) or via a bank transfer directly to delCane’s bank account (payment in advance) the fulfilment of the order will start after the full payment amount (product price plus delivery cost) is credited to the bank account of the intermediaries in the transaction (PayU or PayPal) or to delCane’s bank account.
  6. The maximum order fulfillment time should not exceed 14 business days, and in no case may exceed 30 days from the date of conclusion of the sales agreement.
  7. The customer can check the expected delivery date on the website of the courier company delivering a particular parcel.
  8. On delivery, the customer should check whether the parcel (box and its contents) has not been damaged. If any shipping damage is discovered (damaged box) the customer should prepare a damage report in the presence of the courier and notify delCane immediately (via e-mail to the address [email protected] or using the contact form available on the delCane online store’s website) about the situation. If any shipping damage to the parcel or its content is discovered (damaged box and its contents) the customer should refuse to accept the parcel, prepare a damage report in the presence of the courier and notify delCane immediately (via e-mail to the address [email protected] or using the contact form available on the delCane online store’s website) about the situation.
  9. The risk of loss or damage to the product is transferred onto the customer when they accept the delivery, which does not prejudice the customer’s rights to submit a complaint in regard to the product or any other customer rights under from these Terms and Conditions and the applicable law.

 

VII. RETURNS AND COMPLAINTS

  1. All products offered by the delCane online store are new and genuine. Most of the products on offer in the delCane online store are made from natural full grain leather, which can cause slight variations between the products regarding their texture and colour, and also make them differ slightly from the presented images. Any possible differences to the extent described in the preceding sentence are the result of the use of natural full grain leather, and not a defect of the product, and therefore are not subject to complaint.
  2. Pursuant to the provisions of the Consumer Rights Act, the customer (consumer) shall be entitled to withdraw from the sales agreement, without stating the reason behind such a withdrawal, within 14 days from receiving the product (i.e. from the date of taking possession of the items by the customer or a third person designated by the customer but other than the carrier). Any returns shall be accepted only if a written statement on withdrawal from the sale agreement is delivered within 14 days from receiving the product, and if the product being returned is sent back to the delCane’s address (ul. Fosa 35B/15, 02-768 Warszawa, Poland) within 14 days from the submission of such statement.
  3. A written statement of withdrawal from the sales agreement should be sent, in due time, by mail to delCane address (ul. Fosa 35B/15, 02-768 Warszawa, Poland), or submitted using the return form (sent to the customer together with the delivered product) or using the form constituting Appendix no. 2 to the Consumer Rights Act or in any other way by informing delCane in writing about explicit withdrawal from the sales agreement. When submitting a statement to withdraw from the sales agreement, the customer who has already paid (cash on delivery) for the purchased product is at the same time obligated to provide, in writing, the number of a bank account to which the payment should be refunded.
  4. The product to be returned must not bear any signs of use, must be clean, with original tags and paper labels attached, and must be placed in the original packaging (metal can/sack).
  5. DelCane shall refund the customer any payments (the product price and any costs of the delivery to the customer) within 14 days from the receipt of the customer’s statement to withdraw from the sales agreement, provided that if within the indicated time delCane fails to receive from the customer the parcel containing the product being returned, delCane shall suspend the refund of the payments received from the customer until the parcel containing the product being returned is delivered to delCane’s address, or until a receipt confirming the shipment of such parcel is submitted by the customer. The payments received from the customer shall be refunded with the use of the same payment method as used by the customer, except for the “cash on delivery” payment method. In a situation where the customer paid the courier in cash (cash on delivery), the payments received from the customer shall be refunded to the bank account provided by the customer together with the statement to withdraw from the sales agreement. If payment was made using a payment card the refund will be made to the same card.
  6. DelCane has the right to refuse to accept the return of a product if:
    • the return is made after the allowed time referred to in clause 2 above;
    • the returned product is damaged;
    • the returned product is incomplete.
  7. The cost of returning the product shall be borne by the customer. The delCane online store does not accept returns requiring any payments to be made upon delivery.
  8. DelCane is obliged to provide the customer with a defect-free product and is liable to the customer, who is a consumer within the meaning of Article 221 of the C.C., for the defects of the product (goods) acquired by the customer, within the scope specified by the provisions of the Civil Code, as amended by Consumer Rights Act.
  9. If the product bought in the delCane online store is defective the customer can file a complaint, observing the time limits and terms specified below.
  10. The complaint must be submitted in writing (by mail or e-mail: [email protected]), with the product’s proof of purchase (invoice) attached. The product under complaint must be returned in its original packaging (if possible) to delCane address (ul. Fosa 35B/15, 02-768 Warszawa, Poland) with a note “complaint”. .
  11. In the complaint, the customer should describe the defect and specify their demands.
  12. When submitting a complaint, the customer may, at their discretion, demand a price reduction or withdraw from the agreement, unless delCane proposes to repair the product or replace the product with a new one, free of defects. In addition, instead of the proposed removal of the defect by delCane, the customer may demand the replacement of the product for the one free of defects, or to have the product repaired, unless the method chosen by the customer is impossible or would generate excessive costs for delCane. The customer may not withdraw from the sales agreement if the defect is insignificant.
  13. The customer will be informed about the method of dealing with the complaint within 14 days from the date when delCane receives the package with the product under complaint. If the complaint is accepted, but the method of dealing with it, as proposed by the customer, is impossible or would generate excessive costs for delCane, delCane will propose another method from those referred to above in the preceding paragraphs. Depending on the method of dealing with the complaint, delCane will send to the customer the product free of defects (repaired or new one) within 14 days, and if this is not possible (e.g. due to shortage of product in stock), delCane will refund the price paid for the product or lower the price.
  14. If delCane rejects the complaint the product under complaint will be returned to the customer with the opinion regarding illegitimacy of the complaint. After receiving the opinion regarding illegitimacy of the complaint, the customer is entitled to lodge a request to initiate the mediation proceedings referred to in Article 36 Section 1 of the Act dated 15 December 2000 on Trade Inspection.

 

VIII. PROTECTION OF PERSONAL INFORMATION

  1. DELCANE Ewa Lignowska based in Warsaw at ul. Fosa 35B/15, 02-768 Warszawa (Poland), entered into the Central Business Activity Register of the Republic of Poland, maintained by the Minister of Development [www.firma.gov.pl], NIP (Taxpayer Identification Number): 782‑169‑63‑25, REGON (statistical number): 634362583, is the administrator of personal information and the sole owner of the delCane online store.
  2. The customers’ personal information provided to the delCane online store during the registration process or while placing an order (if the purchase is made without registration), is processed by delCane solely for the purpose of completing the order, and, depending on the customer’s decision expressed while placing the order or on the delCane online store’s settings page, for marketing purposes. The customer shall have the right to review, supplement, update or correct their personal data, as well as to temporarily or permanently suspend the processing of the data, or to have the data removed, if the data is incomplete, outdated, untrue or has been collected in violation of the law, or is no longer required for the purpose for which it has been collected. Furthermore, the customer shall have the right to submit a written request to cease the processing of their personal information for marketing purposes.
  3. Customers’ personal information will be made available to a courier company that performs a particular delivery: DPD Polska Sp. z o.o. or InPost Paczkomaty Sp. z o.o. in the case of the parcels delivered within the territory of the Republic of Poland, and in the case of parcels delivered outside the territory of the Republic of Poland: UPS Polska Sp. z o.o. or DPD Polska Sp. z o.o. – for the purpose and within the scope necessary to perform the delivery service, and will be, each time, made available to the broker, through which the courier services are purchased, i.e. Qlink Sp. z o.o. seated in Warsaw.
  4. The customers’ personal data shall be made available to the company operating the electronic payment system used by the customer to make payments, i.e. PayU (the system operated by PayU S.A. based in Poznań, at ul. Grunwaldzka 182, 60‑166 Poznań, Poland entered into the register of entrepreneurs maintained by the National Court Register under the number KRS: 0000274399) or PayPal (the system operated by PayPal (Europe) S.à r.l. et Cie, S.C.A., based at 22-24 Boulevard Royal, L‑2449 Luxembourg) – for the purpose and to the extent necessary to process the payments.
  5. DelCane, acting in the capacity of the administrator of all personal information provided by customers, shall ensure that the said data is protected in accordance with the provisions of the Personal Data Protection Act.
  6. The customer shall have the right to subscribe to the delCane newsletter. The newsletter is a free-of-charge service intended to inform the delCane online store’s customers about promotions, new products, competitions and other current events, by sending specific information, periodically, to an e-mail address specified by the customer. To receive the free delCane newsletter, the customer must agree to receive it and provide their e-mail to which the newsletter is to be sent. By expressing their consent to receive the free newsletter, the customer authorizes delCane to collect and process their personal information for marketing purposes, in compliance with the provisions of the Personal Data Protection Act, and to receive from delCane, to the e-mail address specified, commercial information in the meaning of Article 10 Section 2 of the Act on provision of electronic services. The Customer may resign from receiving the newsletter at any time, by clicking the link provided at the bottom of each e-mail message received or by changing the settings on the delCane online store’s website, after logging in to their individual customer account. Should the customer opt out of receiving the newsletter, the customer’s e-mail address shall be immediately removed from the delCane’s newsletter database, which fact shall be communicated to the customer by means of an e‑mail message sent to the e‑mail address specified by the customer.

 

IX. TERMS OF PROVISION OF ELECTRONIC SERVICES

  1. In addition to selling products in the online store, delCane also provides an electronic service that allows the creation and operation of an individual customer account in the delCane online store and an electronic service involving sending commercial information (newsletter) ordered by the customer.
  2. Proper use of the delCane online store requires at least:
    • Access to the Internet;
    • A Web browser: Internet Explorer, FireFox, Chrome, Safari;
    • An e-mail account.
  3. The customer should report any irregularities in the operation of the delCane online store, including any interruptions in the operation of the delCane store, in writing by sending an e-mail complaint to: [email protected] or by sending a complaint via the contact form available on the website of the delCane online store on the “Contact” tab.
  4. The complaint should include a description of the irregularity, the date of its occurrence, the customer’s name and e-mail address. DelCane shall process the complaint within 14 days of receiving it, and the customer will be notified about the method of resolving the complaint by e-mail sent to the e-mail address provided by the customer in their complaint. However, if the complaint cannot be processed within that period, delCane shall notify the customer of this fact, indicating the reason for the delay in the processing of the complaint and the planned time of its processing, not later however than 30 days.
  5. Depending on the settings of the customer’s web browser, delCane may introduce cookies to the customer’s IT system, which are not part of the services provided through the delCane store, and which enable, in particular, later identification of the customer browsing through the delCane store, and are used to facilitate the use of the store by the customer, as well as to monitor the customer traffic on the store’s website, generate statistics, manage and administer the delCane store. The customer has access to detailed information about the cookies currently used by the delCane online store on the “Cookie Policy” tab. The customer can, at any time, either disable or limit the delCane online store’s ability to use cookies, by selecting proper settings in their web browser’s settings. However, disabling or limiting the use of cookies may affect some of the functionalities of the delCane online store, e.g. placing an order may turn out to be impossible.

 

X. OTHER PROVISIONS

  1. By placing an order the customer agrees to use the delCane online store in accordance with these Terms and Conditions, in the wording applicable at the date of the order. Refusal to accept the provisions of these Terms and Conditions at the stage of placing an order in the delCane online store makes it impossible to order and purchase the products on offer in the delCane online store.
  2. The sales agreement concluded between the customer and delCane in the delCane online store is governed by the provisions of the Polish law.
  3. In all matters not regulated by these Terms and Conditions, the provisions of the Consumer Rights Act, the Civil Code and the provisions of other laws applicable to the business and operation of the delCane online store shall apply.
  4. In the event of a dispute, delCane shall first attempt to settle the dispute amicably. If the resolution of the dispute in an amicable manner is impossible, the matter shall be resolved by a competent court. The customer has an option to use extrajudicial means of resolving complaints and seeking redress, such as, in particular, the mediation proceedings. The customer is entitled to lodge a request to initiate the mediation proceedings referred to in Article 36 Section 1 of the Act dated 15 December 2000 on Trade Inspection.
  5. DelCane reserves the right to revise these Terms and Conditions at any time. Amendments to the Terms and Conditions shall become effective when published on the delCane online store’s website, with the proviso that these changes may not violate the acquired rights of customers using the delCane online store.
  6. DelCane reserves the right to make, at any time, changes to the prices and products on offer in the delCane online store, to introduce or withdraw individual products to/from the delCane online store and to conduct, modify and withdraw promotional campaigns carried out on the delCane online store’s website.
  7. DelCane shall take all measures to ensure proper operation of the delCane online store, to the extent that results from the current technical knowledge, and undertakes to remove immediately any irregularities in the store’s operation. However, delCane shall not be liable for any disruptions to the delCane online store’s operation caused by problems with the Internet.
  8. 8. All photos, publications, texts, logos published on the delCane online store’s website, including the store’s graphics, are the sole property of delCane or its suppliers, and they are protected in accordance with the provisions of the Act of 4 February 1994 on copyright and related rights. Any unauthorized duplication, reproduction or distribution of any content, including photos published on the delCane online store’s website is forbidden.
